Clarity Terms of Service
1. What Clarity is — and is not
Clarity is a marketplace venue: short-form and live video where independent creators ("Presenters") demonstrate and sell their own products, and community members report whether something worked for them. Clarity is not the seller of any product. Every purchase is a transaction between you and the Presenter, who is the merchant of record. Clarity provides the venue, the payment rails (via Stripe), and community data, and charges the Presenter a platform fee on each sale.
Clarity is a general-wellness platform. Nothing on Clarity — including videos, community verdicts, ground-truth statistics, or answers from Clarity — is medical advice, diagnosis, or treatment. Always consult a licensed clinician for medical questions. If this is an emergency, call 911.
2. Eligibility
You must be 18 years or older to create an account. Accounts are tied to a verified mobile phone number; one account per person. By registering you consent to receive one-time passcode (OTP) text messages for login (standard message rates apply). We do not send marketing texts without separate opt-in consent.
3. Purchases, returns, and refunds
- The Presenter is the seller and merchant of record. Payment is processed on the Presenter's own Stripe account. Your card statement, receipt, refund rights, and any dispute run against the Presenter.
- All returns, refunds, exchanges, and chargebacks are handled by the Presenter under the Presenter's stated policy, consistent with applicable law (including N.Y. Gen. Bus. Law § 218-a refund-policy disclosure requirements). Clarity does not accept returns and does not issue refunds.
- Clarity's platform fee is charged to the Presenter, not to you, and is disclosed to Presenters before listing.
- "Verified buyer" means the voter completed a paid order for that item through Clarity. Vote percentages display the verified-buyer share so you can weight them accordingly.
4. Presenter obligations
- Presenters must own or be authorized to sell every product they list, must honor their stated return policy, and are solely responsible for product safety, labeling, and legal compliance.
- Health-claim rules: no diagnosis or treatment claims; no claims that a product cures, treats, or prevents disease. Claim language in listings is subject to review and listings may be paused pending review.
- FTC endorsement compliance (16 C.F.R. Part 255): material connections must be disclosed; paid partnerships are labeled. Presenters may not vote on their own products or procure fake votes.
- Prescription-medication topics are discussion-only; no purchase functionality is available on such content.
5. Community verdicts
Works/Doesn't votes are individual experience reports, limited to one per account per item, and are not scientific evidence or medical claims. Manipulating votes (multiple accounts, bots, incentivized voting without disclosure) is grounds for termination and forfeiture of pending payouts.
6. Clarity — AI transparency
Clarity is an artificial-intelligence assistant and is labeled as such wherever it appears. Clarity's answers are generated from community report data and a citation-backed evidence engine; they are informational only, may be incomplete or incorrect, and are never medical advice. Clarity routes clinical questions toward licensed clinicians. You are never in a conversation with a human when talking to Clarity. We do not use AI to impersonate humans, and material AI-generated statistics are labeled with their source and sample status.
7. Live content and the 24-hour rule
Live streams and live-drop content are ephemeral by design: they expire and are deleted within 24 hours of the stream's start. Purchase records persist (see Privacy Policy) so buyers retain proof of purchase. Do not rely on Clarity to archive live content.
8. Acceptable use
No unlawful content or conduct; no harassment; no medical misinformation presented as fact; no sale of prescription drugs, controlled substances, or recalled products; no scraping or automated account creation; no interference with the service. We may remove content and suspend or terminate accounts that violate these terms.
9. Payments processing
Payments are processed by Stripe, Inc. Presenters additionally agree to the Stripe Connected Account Agreement. Clarity never stores full card numbers.
10. Disclaimers and limitation of liability
The service is provided "as is" and "as available." To the maximum extent permitted by law, Clarity disclaims all warranties, and our aggregate liability arising out of the service will not exceed the greater of $100 or the platform fees we earned from your transactions in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited under New York law, including under N.Y. Gen. Bus. Law §§ 349–350, or your non-waivable consumer rights.
11. Disputes, governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved by binding individual arbitration in New York County, New York (AAA Consumer Rules), and both parties waive class actions and jury trials, except that (a) either party may bring an individual claim in small-claims court, and (b) you may opt out of arbitration within 30 days of account creation by emailing legal@healthai.com.
12. Changes; termination; contact
We may update these terms with notice in-app; continued use after the effective date is acceptance. You can close your account at any time in Profile. DMCA notices and legal correspondence: legal@healthai.com · HealthAI, [registered address], New York, NY.
